Services Provided ChatCanal offers a SaaS platform for managing WhatsApp communications and integrations with other platforms like Messenger and Instagram (when fully implemented). Services include: Communication management for businesses. Bot integration and automation. Contact, template, group, and campaign management. Vendors are service providers who integrate their offerings into the platform, such as providing additional services to end-users. 3. User Responsibilities As a User, you agree to: Accurate Information: Provide true, accurate, and complete information during registration. Security: Keep your account login credentials confidential. Compliance: Use the platform in compliance with applicable laws (data privacy, consumer protection, etc.). Prohibited Use: You may not use the platform for illegal activities, transmitting harmful or abusive content, or violating third-party intellectual property rights. As a Vendor, you agree to: Service Availability: Ensure that your services are available and functional as per the agreements with users. Quality Control: Maintain high service standards and promptly resolve any issues or complaints from users. Data Privacy: Ensure any data collected through your services complies with the platform's privacy policy and data protection laws. 4. Subscription and Payments ChatCanal offers subscription-based access to its services for Users. By subscribing, you agree to pay the applicable fees for the selected subscription plan. Payments are recurring and will automatically renew unless canceled. Vendors are paid for services provided to users through the platform, as per the terms set in separate vendor agreements. All payments made to ChatCanal are non-refundable unless otherwise stated in our Refund & Cancellation Policy. 5. Service Availability and Downtime While ChatCanal strives for maximum uptime, we do not guarantee uninterrupted service. In case of downtime due to technical issues, we will extend the subscription for the duration of the downtime as stated in our Refund & Cancellation Policy. We are not liable for any business or financial loss caused by service interruptions. 6. Data Privacy and Security ChatCanal is committed to protecting your data. We collect, store, and process user data in accordance with our Privacy Policy. Both Users and Vendors agree to adhere to the privacy and data protection guidelines outlined in the policy. By using the platform, you consent to the collection and use of your data as outlined. 7. User Conduct You agree to not: Engage in spamming, data scraping, or other harmful activities. Use the platform for fraudulent or illegal purposes. Violate any intellectual property or privacy rights of others. Vendors agree to provide services in accordance with ChatCanal’s terms and not engage in harmful practices like providing false information or violating user privacy. 8. Subscription Cancellation and Refund Policy Users may cancel their subscription at any time; however, payments are non-refundable. Any cancellation will be effective at the end of the billing cycle. Users may be eligible for service extensions in case of downtime, as described in our Refund & Cancellation Policy. Vendors are responsible for managing their payment processes and ensuring services are delivered as agreed. 9. Limitation of Liability ChatCanal shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the platform. This includes but is not limited to loss of revenue, data loss, or any business disruption. The total liability of ChatCanal, whether in contract or tort, is limited to the amount paid by the user in the last subscription cycle. 10. Termination and Suspension ChatCanal may suspend or terminate access to the platform if: You violate these Terms and Conditions. You fail to make timely payments. You engage in fraudulent activity or illegal conduct. Termination for Vendors will be governed by specific agreements made between the vendor and ChatCanal. 11. Modifications to Terms ChatCanal reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website, and they will become effective immediately upon posting. Continued use of the platform after any updates will constitute your acceptance of the revised Terms. 12. Dispute Resolution Any disputes arising from or in connection with these Terms shall be resolved in accordance with the laws of India. Disputes will be settled under the jurisdiction of the courts in Jaipur, India. 13. Governing Law This Agreement is governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. 14.
